Todochi
These Terms of Service and End User License Agreement ("Agreement") govern your access to and use of Todochi ("the App"), developed by Lagooners ("we," "us," or "our"). By downloading, installing, accessing, or using the App, you agree to be bound by this Agreement. If you do not agree to these terms, please do not install or use the App.
You must be at least 13 years old to use Todochi. By using the App, you represent that you meet this requirement.
Subject to your compliance with this Agreement, Lagooners grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a compatible device that you own or control, solely for your personal, non-commercial use.
This license does not transfer any ownership rights in the App to you. All rights not expressly granted to you under this Agreement are reserved by Lagooners.
You agree that you will not, and will not permit others to:
The App, including its software, design, characters, artwork, audio, text, branding, and other associated intellectual property, is owned by or licensed to Lagooners and is protected by applicable intellectual property laws.
This Agreement does not transfer any ownership rights to you. All rights not expressly granted under this Agreement are reserved by Lagooners.
You may use Todochi as a guest, or create an account using email and password, Google Sign-In, or Sign in with Apple.
If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. You agree to provide accurate information when creating or maintaining your account.
You may delete your account through the App's Settings, subject to any applicable limitations described in our Privacy Policy.
Todochi offers an optional premium subscription that unlocks additional companion characters, features, or other premium content.
Subscriptions are purchased through the in-app purchase system of the app store from which you obtained the App. RevenueCat is used as our subscription management provider to help us manage and verify subscription entitlements.
The applicable price, billing period, and subscription terms will be presented to you before you complete a purchase. Subscriptions may automatically renew unless you cancel them before the applicable renewal date.
Subscriptions are managed through your account with the app store from which you obtained the App, using that store’s subscription management system.
You may manage or cancel your subscription through the applicable app store's subscription settings, or through the "Manage subscription" option provided within the App when available. Deleting or uninstalling the App does not necessarily cancel an active subscription.
Refunds, billing disputes, and payment processing are handled according to the applicable platform's policies and procedures.
Your use of the App, including the information we collect, how we use it, how it is stored, and your privacy choices, is described in our Privacy Policy.
Depending on how you use the App, account and profile information may be processed through third-party services including Firebase, Google Sign-In, Sign in with Apple, and RevenueCat, as described in our Privacy Policy.
Reminders and other content you create in the App may be stored locally on your device. You should not rely on the App as your sole backup for critical information.
The App may rely on third-party services and platforms to provide authentication, subscription management, payment processing, hosting, storage, and other functionality.
Your use of the App may therefore also be subject to the applicable terms and policies of third-party providers, including Apple, Google, your app store provider, and other services used by the App.
Where a third-party platform has its own terms governing platform-specific matters, those terms will apply to your relationship with that platform. Nothing in this Agreement is intended to override the applicable terms, policies, or requirements of Apple, Google, your app store provider, or other platform providers.
Todochi is designed to provide reminders and alarms, but we cannot guarantee that every reminder or alarm will be delivered or displayed under every device condition.
Reminder and alarm behavior may be affected by device settings, operating system restrictions, battery-management features, notification settings, permissions, network conditions, device availability, or other factors outside our control.
You are responsible for configuring the App and your device's relevant permissions and settings appropriately. Todochi should not be relied upon as the sole means of receiving time-critical or safety-critical notifications.
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by applicable law.
We do not warrant that the App will be uninterrupted, error-free, secure, or available at all times, or that reminders, alarms, notifications, subscriptions, account services, or other App features will operate without interruption or failure.
If you provide feedback, bug reports, suggestions, or other comments about the App, you agree that we may use that feedback to improve Todochi without any obligation to compensate you or attribute the feedback to you.
To the maximum extent permitted by applicable law, Lagooners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of, or inability to use, the App, even if we have been advised of the possibility of such damages.
This includes, to the extent permitted by applicable law, damages or losses resulting from missed reminders, missed alarms, device restrictions, loss of locally stored data, service interruptions, or failures of third-party services.
This Agreement remains effective until terminated.
We may suspend or terminate your access to the App or revoke the license granted under this Agreement if you materially violate these terms or use the App in a manner that may harm the App, other users, or our services.
You may terminate this Agreement at any time by stopping your use of the App and, if applicable, deleting your account through the App's Settings.
Termination of this Agreement does not automatically cancel a subscription purchased through Apple or Google. Subscription cancellation must be completed through the applicable platform's subscription management system.
We may update this Agreement from time to time as Todochi evolves. When we make material changes, we will update the Effective Date above and, where appropriate, provide additional notice through the App or other reasonable means.
Your continued use of the App after the updated Agreement becomes effective constitutes acceptance of the revised terms, to the extent permitted by applicable law.
This Agreement shall be governed by the laws of the Republic of the Philippines, without regard to its conflict of law provisions.
Any disputes arising from or relating to this Agreement shall be resolved by the appropriate courts of the Philippines, subject to any mandatory rights or protections that may apply to you under the laws of your place of residence.
